Stair lift: warranty, maintenance and everyday safety

Three-year legal guarantee, commercial warranty, CE marking and daily checks. We found no compulsory servicing by law for home stair lifts. See the sources.

In short

  • Three-year legal guarantee from delivery (with installation, from the end of installation); in the first two years a defect is presumed to have existed already (Decree-Law 84/2021, arts. 11 to 13).
  • A commercial warranty adds to the legal one and cannot limit it (arts. 43 and 51).
  • We found no compulsory servicing or inspection by law for a home stair lift: Decree-Law 320/2002 deals with lifts, goods lifts, escalators and moving walkways.
  • A stair lift is a machine: CE marking, EC declaration of conformity and a manual in Portuguese (Decree-Law 103/2008).

Once the stair lift is installed, three questions remain: what the law guarantees if it breaks down, whether servicing is compulsory, and what you can check every day. This guide answers with the texts we read and says what we could not confirm.

Updated on 3 November 2026. General information; it does not replace the opinion of a lawyer, of the Directorate-General for Consumers or of a qualified technician.

The essentials

  • Three-year legal guarantee. It runs from delivery; if the contract includes installation, it only starts when installation is finished (Decree-Law 84/2021, arts. 11(2) and 12(1)). In the first two years a defect is presumed to have existed already (art. 13).
  • A commercial warranty adds to the legal one. Clauses that limit the consumer’s rights are void (art. 51).
  • Compulsory servicing by law? We found none. Decree-Law 320/2002 deals with lifts (ascensores), goods lifts, escalators and moving walkways. It does not name stair lifts.
  • A stair lift is a machine: CE marking, an EC declaration of conformity and a manual in Portuguese (Decree-Law 103/2008).
  • After a fault or an incident: stop using it, write to the installer by a means that leaves proof, and keep everything.

Decree-Law 84/2021 applies to contracts between a consumer (a natural person, outside their professional activity) and a trader, and to goods supplied under a works contract or another service contract (arts. 2 and 3). The updated text we read shows no amendments.

  • Period: three years for the lack of conformity to show up (art. 12(1)). It is suspended from the notice until the stair lift is put right (para. 4).
  • Proof: up to two years, the fault is presumed to have existed at delivery. After that, the consumer must prove it (art. 13).
  • Notice: by letter, e-mail or another means that allows proof (art. 12(5)). In the articles we read there is no maximum time to give notice. Give it at once.
  • Rights: repair or replacement, your choice (art. 15), free of charge, within a reasonable time and, as a rule, within 30 days (art. 18(2) and (3)).
  • Removing and refitting: if the repair needs it, the trader bears the cost (art. 18(5)). Each repair adds six months of guarantee, up to four times (para. 4).
  • If the repair fails: price reduction or termination of the contract (art. 15(4)). The rights lapse two years after the notice (art. 17).
  • Parts: the producer must have them for 10 years after placing the last unit of the model on the market (art. 21).

Commercial warranty and maintenance contract

A commercial warranty is an extra promise by the seller or the maker, on top of the legal guarantee (art. 2(k)). It must be in writing, in clear Portuguese, with what it covers, the charges, the duration and who the guarantor is, and say that legal rights are not affected (art. 43(5) and (6)). If the advert and the declaration differ, the one more favourable to the consumer applies (para. 3).

A manufacturer’s manual we read describes free repair for 24 months, without batteries or remote control. It is not your contract, and the legal guarantee does not depend on it.

We found no rules for stair lift maintenance contracts. The lifts law distinguishes a simple contract, with no replacement of components, from a complete one (Decree-Law 320/2002, art. 5): use that as a question. Ask in writing for:

  • the maximum response time to a fault and who answers the phone;
  • whether parts, batteries and remote control are included;
  • visits per year, duration and how to cancel.

There are no official prices. To compare offers, see comparing stair lift quotes.

Servicing and inspection: is it compulsory?

Decree-Law 320/2002 requires regular maintenance by a registered company, under contract (arts. 3 and 4), and periodic inspections by the municipalities (art. 8), for “lifts, goods lifts, escalators and moving walkways” (art. 1). The DGEG page repeats the list and does not mention stair lifts or platforms.

Article 1(2) excludes what Decree-Law 295/98 excluded. That decree was repealed by Decree-Law 58/2017. The new one defines a “lift” as an appliance serving defined levels by a car moving on rigid guides, and does not apply to appliances with a speed of 0.15 m/s or less (arts. 2(3) and 3). The manual we read gives 0.15 m/s as the maximum speed of that model.

The honest conclusion: we found no maintenance or inspection duty for a home stair lift, but no text excludes it in so many words. Ask the town hall in writing. A lift with a cabin is a different case: see the home lift guide.

CE marking, declaration of conformity and manual

A stair lift with a motor is a machine. Under Decree-Law 103/2008 (consolidated version), the manufacturer must supply the manual, draw up the EC declaration of conformity, make sure it goes with the machine and affix the CE marking, visible, legible and indelible (arts. 5 and 10). The manual comes in Portuguese (annex I, 1.7.4). Directive 2006/42/EC asks it to explain use, maintenance and repair (1.7.4.2). Ask the installer for the declaration and the manual.

We did not read standard EN 81-40 (it is paywalled). We saw it cited in a manufacturer’s certificate dated 1 October 2015 (2008 edition). Regulation (EU) 2023/1230 replaces the directive from 20 January 2027.

Everyday safety checks

These come from a manufacturer’s manual in Portuguese (version 2.4, undated). Your model may differ: follow your own manual.

  • Rail clear of obstacles and well lit. Abnormal noises or damage: do not use it and tell the installer.
  • Before riding: armrests and seat down, feet inside the footrest, belt fastened. With the seat swivelled or an armrest raised, it will not move.
  • Battery: stop at a charging point. If it does not connect properly, it beeps and the light flashes. With no charge, it does not work. Never pull the plug. Change the remote control batteries.
  • After use: take out the key. Children and pets away.
  • Fire: it is not a means of escape, says the manual. For stair width in an apartment building, see the apartment building guide.
  • Power cut: the text we read does not say what happens. Ask for instructions in writing.

If there is a fault or an incident

  1. Stop using it and take out the key. If anyone was hurt, get medical help.
  2. Write to the installer by e-mail or registered letter: date, model, serial number, what happened, photographs. Keep the invoice, the warranty and the service reports.
  3. Ask for the repair and a deadline.
  4. If they do not answer: the Complaints Book (Livro de Reclamações), also electronic, is compulsory for suppliers of goods and services (Decree-Law 156/2005, art. 2). The Directorate-General for Consumers examines complaints and the arbitration centres handle consumer disputes.

To choose equipment, use the choice tool or read stair lift or platform.

What we could not confirm

  • Whether Decree-Law 320/2002 covers a home stair lift. We read the published text, not the consolidated version, and art. 1 points to a repealed decree.
  • Whether an installed stair lift counts as a movable good under this law (no rulings read).
  • Whether worn batteries and remote control fall under the legal guarantee.
  • The content of EN 81-40, and what the stair lift does in a power cut.
  • Whether annual services are a condition of the commercial warranty: it depends on your declaration.
